Welcome to Hire Africa, a freelance and service marketplace that connects professionals across Africa with global and local clients. By accessing or using our platform, you agree to be bound by the following Terms and Conditions (“Terms”), our Privacy Policy, and any additional guidelines or policies posted on the platform.

If you do not agree to these Terms, please do not use our platform.

2. Definitions

  • “Platform” refers to the Hire Africa website, mobile apps, services, and related applications.
  • “User,” “You,” “Your” refers to any individual or entity that registers or uses the platform.
  • “Client” refers to users who post jobs or request services.
  • “Freelancer” refers to users offering and delivering services on the platform.
  • “We,” “Us,” “Our” refers to Hire Africa (registered under Multitalented Holdings Limited).

3. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding agreement to use the platform. By registering, you represent and warrant that you meet all legal requirements for eligibility.

4. Account Registration and Security

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and complete information during the registration process.
  • We reserve the right to suspend or terminate your account if we believe any information is inaccurate or violates our policies.

5. User Obligations

  • You agree not to use the platform for any unlawful purpose.
  • You shall not violate any applicable laws, third-party rights, or platform policies.
  • Clients agree to pay for services rendered, and Freelancers agree to deliver work in a professional and timely manner.

6. Payments and Fees

  • Payments are facilitated through third-party payment processors.
  • Hire Africa may charge a service or commission fee for transactions, which will be disclosed prior to confirmation.
  • All fees are non-refundable unless stated otherwise in our Refund Policy.

7. Intellectual Property

  • All content, trademarks, designs, and software on the platform are the property of Hire Africa or its licensors.
  • Users retain ownership of any content they create, but grant Hire Africa a non-exclusive, royalty-free, worldwide license to use such content for marketing, promotion, and platform operation.

8. Dispute Resolution

  • Hire Africa encourages users to resolve disputes amicably. If not possible, users may submit the issue through our internal dispute resolution process.
  • Hire Africa is not liable for disputes between users but may mediate at its sole discretion.

9. Termination

We may terminate or suspend your account without notice if you breach these Terms or use the platform in a way that causes harm to others or to the platform. Upon termination, your access to the platform will be revoked.

10. Limitation of Liability

To the maximum extent permitted by law:

  • Hire Africa is not liable for any indirect, incidental, special, or consequential damages.
  • We do not guarantee the reliability, quality, or legality of services provided by users.

11. Indemnification

You agree to indemnify and hold harmless Hire Africa, its affiliates, and staff from any claims, liabilities, damages, and expenses (including legal fees) arising from your use of the platform or violation of these Terms.

12. Privacy

Our collection and use of personal information are governed by our Privacy Policy, which is incorporated by reference into these Terms.

13. Changes to Terms

We may update these Terms at any time. You will be notified of significant changes via email or platform notices. Continued use of the platform after such updates constitutes your agreement to the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Malawi. Any disputes shall be resolved by the competent courts of Malawi unless otherwise agreed through arbitration or mediation.
